Unofficial Primary election results Aug. 30, 2016

Unofficial Results of tonight's election are in! 


Quartzsite, AZ The results do not include an estimated 600 Provisional Ballots and Late Early Ballots which will take a few days to count. Tomorrow may show an update to these numbers and the final results should be completed Thursday.

In the Quartzsite mayoral race, former Vice Mayor Norm Simpson is in the lead with 144 votes, followed by Dr. Christina Anastasia with 70 votes. Robert "Gunny" St. Germain has 68 votes, with incumbent Mayor Ed Foster bringing up the rear with 67 votes. The top 2 will go forward to the November General Election.

In the Quartzsite Town Council race, Starr BearCat is in the lead with 157 votes, followed by Jerald Kinkade with 150 votes. Deanna Sheehan has 136 votes, followed by Monica Timberlake with 125 votes. We'll know more on Thursday if candidates move on to General Election in November.

At the county level:

SUPERVISOR District 2 which includes Quartzsite north: 
Republican race: Duce Minor taking the lead with 299 votes, followed by George Nault with 173 votes. Charlie Philpot has 166 votes, Danny Dickinson has 64 votes and Jay Clagg has 41 votes.

Republican race for SHERIFF:
Bill Risen with 769 votes over incumbent John Drum with 618. William Smith has 132 votes.

Republican race for COUNTY ASSESSOR:
Challenger Anna Camacho has a lead with 803 votes. Incumbent Sharon Schuler has 684. With no Democrat running in November an a huge lead, it appears Camacho will be the winner.

Tues. Nov. 27th Quartzsite Town Council meeting agenda

It appears it will be another long meeting for the Quartzsite Town Council next Tuesday. Mayor Ed Foster has placed Items which were pulled from the Nov. 13th's agenda back on Tuesday's agenda. There are 14 new business items, including a presentation regarding solar grants awarded to the Town awarding of $12,000 Economic Development Funds, and four Planning and Zoning requests. AG declines prosecution of Quartzsite Police Chief Jeff Gilbert based upon DPS investigation


For Immediate Release: Statement from Quartzsite 
Chief of Police Jeff Gilbert on DPS Report #2011-027462


Quartzsite, Arizona - On August 13, 2012, I received a completed copy of the criminal investigation conducted by the AZ Department of Public Safety (DPS) against myself and Sgt. Xavier Frausto. This report included the "Turndown" notice declining the case by the AZ Attorney General's Office, dated July 12/13, 2012. The allegations and complaint was initiated by then Quartzsite Mayor Ed Foster.

The case was declined for the following reasons stated by the turndown report as: "Victim/Witness Credibility Problems"; "Inadequate Evidence of Intent"; "Inadequate Evidence of Corroboration"; and "No Reasonable Likelihood of Conviction".

This is the third criminal investigation I have been subjected to along with members of my department from false allegations and complaints made by then Mayor Ed Foster. I have been exonerated, along with the other members of the department each time. Sergeant Xavier Frausto has served this community for nearly twenty years with his complete dedication to the community.

I have documented evidence that Ed Foster participated with another party and submitted a fabricated and forged letter to DPS in 2010 in an attempt to lend credibility to the first of his false allegations and complaints. While I brought this matter to the attention of DPS, to my knowledge they declined any further investigation of the incident.

Ed Foster, along with others, continues to this day in his attempt to discredit, and have me criminally charged, as the Chief of Police for the Quartzsite Police Department. His latest false allegations and complaints created an investigation and finding period that lasted nearly fourteen months resulting in an unknown loss and waste of the tax payer's dollar, not to mention the undue hardship that was created to the community, the Town, the Department, Sgt. Frausto, myself and our families. 

On behalf of the Quartzsite Police Department, myself and all those affected, I wish to thank the Town and community members of Quartzsite that have provided their continued support and stood behind us over the course of these false allegations and complaints.

I will continue with my dedication to the Town of Quartzsite as Chief of Police, to serve and protect and to provide the best possible police services to the community. Again, I wish to thank everyone for their support.

Quartzsite Town Council refused to seat 2 elected officials

Quartzsite, Arizona- In an unprecedented move this morning, Quartzsite Town Council voted not to seat mayor-elect Ed Foster and council-elect Mark Orgeron. Council voted that Pat Workman is qualified to be seated as council person. 


Quartzsite Town Council held a special meeting at 9am to canvass the votes of the May 15th election and judge qualifications of three persons elected to the council. Town Manager, Alex Taft, explained they have "identified approximately168 voters that we need to look at more thoroughly, for a variety of reasons; out of state license plates, out of state registration, mailing addresses that are out of state, people who have not had their rights restored voting, people that are living in outlining areas and claiming they're living in town."


Council approved the canvass after Town Attorney, Martin Brannan explained the council has no other option. Brannan explained they "are accepting the count that was presented by the elections department."


Council met in three executive sessions for items on the agenda of judging the qualifications of Foster, Orgeron and Workman. When council returned, they voted that Foster is not qualified to be seated as mayor per Quartzsite Town Code. Section 2-1-10  (Ordinance 9-15) that "includes no delinquent or fixed fines, and penalties, user fees, permit fees and sales tax be owed to the Town of Quartzsite at the time of declaration of candidacy."


Council voted that Orgeron was not qualified to be seated after Brannan explained the law states one cannot be a "resident voter in another county."

Workman will replace Joe Winslow on the council. Swearing in will take place in the near future by Judge Lawrence King, who is not in town today.

Quartzsite citizens seek investigation of Mayor Lizarraga for Civil Rights Violations, Assault, Abuse of Power

Dear Sirs and Mesdames:
We have remained silent for too long.  Our town has been overrun by miscreants, malcontents and “sovereign citizens” hell-bent on destruction.  We have reason to believe that they have exploited loopholes and outright violated state law to steal an election by influencing non-residents to vote in our local election and that they have engaged in an ongoing effort to intimidate the good and law-abiding citizens of the town of Quartzsite into avoiding any active participation in town government by creating repeated disturbances at town hall, the town police station and at town meetings and by engaging in aggressive behavior toward anyone with a view different from their own.

Things have escalated recently when this “outlaw faction” co-opted the town’s mayor and somehow got him to do their bidding by attempting to force the town to swear their leaders into office before the existing council could properly canvass the election and judge the qualifications of the council members-elect and mayor-elect as is the current council’s right and duty.  This has led to conduct that we have tolerated before but about which we can no longer remain silent.

1.    Civil Rights Violations
We have information and belief to suspect that Quartzsite Fire District Board Member John Prutch used his position as a member to influence Mayor Jose Lizarraga, a fire Captain whom Prutch, though his control of the Fire Board, has the ability to fire, to attempt to coerce the Town Council and the Town Administration into prematurely canvassing an election, foregoing the judgment of qualifications of those who were ostensibly elected and forcing the immediate cessation of terms of office of properly elected council members.  To accomplish this, we have information and belief that Lizarraga first attempted to bully Vice Mayor Cowell and Town Manager Taft into acquiescing to his demand that the canvass and swearing in of new officials be placed on the agenda without a draft resolution.  This bullying consisted of abrasive, abusive and untoward language directed at this female council member and female administrator which  Lizarraga is not known to direct toward male council members or staff.  In fact, we have information and belief that, when he addressed Town Attorney Brannan, who our information indicates was present during much of this brow-beating session, he toned down his commentary after Mr. Brannan did not retreat from his onslaught.  We also have information and belief that  Lizarraga “poked” Mr. Brannan when commenting about Brannan not having a draft ordinance, which  Lizarraga subsequently decided he didn’t want to present after it was created, ready the same day the  Lizarraga asked for it.  Our information and belief is that Mr. Brannan left the Town Manager’s office after this encounter.

Our information and belief indicates that  Lizarraga increased the tone of his invective during the period of time when Mr. Brannan had left the room.  We further have information and belief that Mr. Brannan took a seat further away from  Lizarraga in an apparent effort to avoid being physically contacted by  Lizarraga as the brow-beating continued.
We understand that after  Lizarraga concluded that he would not be getting his way, he left the room saying words to the effect that “after this morning I won’t have any friends.”  This preceded  Lizarraga wholly abandoning his duties as elected mayor and attempting to terminate a lawfully noticed and convened meeting of the Town Council.

We believe that this conduct, which we have information and belief is not an isolated event but rather is a continuation of the verbal abuse and belittling of female council and staff members, created a hostile work environment which infringed on the rights of the female council members and staff of the town of Quartzsite based on their gender.  Sex-based discrimination is intolerable to us.  We recognize that, as a firefighter, Lizarraga is part of a “boys will be boys” culture and may think that such conduct is acceptable because his firefighting subordinates accept it.  We suspect, however, that just as he chooses different words to try to influence other male council and staff members, he chooses to act differently around his male companions.

We are asking that you investigate Jose Lizarraga for violating the civil rights of the female council and staff of the town of Quartzsite.  We are also asking that you investigate Richard Oldham, Ed Foster, Mark Orgeron, Patricia Workman, John Prutch, Tony Carnevale, Jose Lizarraga, Jack Jones, Jennifer Jones, Douglas Gilford, Teri Gilford, Michael Roth and Dana Stadler for violating the civil rights of the citizens of Quartzsite to take part in municipal government by creating a hostile environment in council meetings, engaging in conduct intended to intimidate citizens with differing views – including verbally abusing and physically threatening residents, and for voter fraud through the intimidation of voters, the purchasing of votes for something of value and the encouragement of nonresidents to vote.

Additionally, we ask that you investigate the La Paz County Elections department whom we have information and belief permitted Teri Gilford to be part of the vote collection, collating and counting process even after being advised that Gilford posted a comment advising that those voting by mail need not be bona fide residents of the town and which we have information and belief has been unnecessarily and unreasonably been withholding the names of the voters at the May 15, 2012 election to delay an investigation into voter fraud until after the Council is statutorily required canvass of the vote on June 4, 2012; the La Paz County Attorney and La Paz County Sheriff, whom we have information and belief met with mayor-elect Ed Foster and may have conspired to, or have been solicited to, assist Foster in forcing the premature transfer of authority without a proper canvass or qualification proceeding.

2.    Assault
We have information and belief that Jose Lizarraga maliciously threatened and assaulted Town Attorney Martin Brannan and then made a false report against him with the intent to impede his ability to serve the town of Quartzsite.  On information and belief,  Lizarraga has a reputation as a person who “hates” lawyers and engineers, possibly because they have a command of skills which escape his grasp.  We have information and belief that  Lizarraga has stated this hatred publicly on multiple occasions and that, upon meeting Mr. Brannan in Ms. Taft’s office for the first time told Mr. Brannan that he (Lizarraga) didn’t like Mr. Brannan, but that was okay because he (Lizarraga) hated all lawyers.

We have information and belief that Lizarraga made no secret, following that initial meeting, that he considered Mr. Brannan anything other than an impediment to doing whatever he wanted as mayor.  Mr. Brannan serving as such an impediment apparently continued on the morning of May 22, 2012 when Mr. Brannan repeatedly defended Vice-Mayor Cowell and Ms. Taft from Lizarraga’s verbal abuse.

This appeared to continue after Lizarraga exceeded his authority and prematurely adjourned the May 22, 2012 council meeting when Lizarraga taunted Mr. Brannan by saying words to the effect, “what are you going to do Martin, arrest me?”  On information and belief, Mr. Brannan then left the council chambers to go to his office to research the illegality of Lizarraga’s actions and the Council’s options for proceeding.  As Mr. Brannan passed Lizarraga in the hallway, our information and belief is that Mr. Brannan said, “who the fuck do you think you are, Jose? You’re the mayor not a dictator,” at which time we believe that Lizarraga stepped into Mr. Brannan’s “personal space” causing Mr. Brannan to put his arm out to cease Lizarraga’s ingress.  We believe that this conduct was observed by Council Member Winslow.  We also believe that there is a video of the hallway where the incident took place that supports what we believe Mr. Winslow saw.

We believe that Lizarraga then falsely claimed to have been assaulted by Mr. Brannan and demanded that Quartzsite Police Sergeant Frausto and Quartzsite Police Chief Gilbert arrest Brannan for assault.  We understand that Lizarraga has since decided that there really was no assault and has said “the physical contact was not much and I told LPSO as much.”  If, as it would appear, Lizarraga now admits that he wasn’t assaulted, his statement to law enforcement that he was assaulted is a criminal act.  Further, if, as we believe Mr. Winslow observed, Lizarraga entered into Mr. Brannan’s “personal space” we believe that this is an assault.  Finally, Lizarraga’s claim that being asked “who the fuck [he] thought [he] was?” and being told that he is not a dictator constitutes a threat is ludicrous.  No reasonable person could ever find those statements, especially in light of Lizarraga’s attempt to dictate the actions of a majority of the Council (everyone except him) to be anything other than an inquiry that every member of the Council (and all of us) would like an answer to.

We are asking that you investigate Lizarraga for assault and for false reporting to law enforcement.  We also suspect that Lizarraga’s actions may constitute a crime of bias based on Mr. Brannan’s status as a service-connected disabled American veteran.

3.    Abuse of Power
Finally, we are asking that you investigate the Quartzsite Fire District Board.  On information and belief there has been conduct committed by that Board, including the use of Fire District property and personnel, to influence an election.

The Quartzsite Fire District Board consists of John Prutch and Tony Carnevale.  Prior to May 24, 2012, Larry Ekberg was also a member, but we have information and belief that he resigned in protest to the actions of Prutch and Carnevale.  John Prutch is a recent council candidate who is appealing his loss to the Arizona Court of Appeals.  He and Carnevale are purportedly supporters of Ed Foster, Patricia Workman and Mark Orgeron.  Shortly before May 15, 2012, we believe that Prutch used fire department property, reportedly a swamp cooler and a barbecue grill, to serve potential voters at a “rally” for Foster, Workman and Orgeron.  We further believe that Prutch used fire department personnel to transport the grill and cooler to and from the rally.  We also believe that Prutch has used this and other fire department equipment for his own personal purposes having no nexus to proper fire district business.  We suspect, but do not have substantial information that Carnevale was complicit in these actions.

We have additional information and belief that the fire district was scheduled to have a budget meeting on May 24, 2012 at 2:00 pm.  We believe Mr. Ekberg, who is currently away from Quartzsite drove a substantial distance to attend this meeting only to learn that Prutch and Carnevale, without having a public vote, cancelled the meeting in order to permit Lizarraga to appear at a hastily scheduled Town Council meeting intended to force a canvass of the election and swearing in of new officials against the will of a majority of the Common Council.  We have information and belief that when Mr. Ekberg directly confronted Prutch and Carnevale that they had cancelled the budget meeting without a vote for the purpose of forcing the town to name Ed Foster mayor, Prutch and Carnevale admitted that they had causing Mr. Ekberg to resign from the Board in disgust.

We also have information and belief that Mr. Ekberg was the primary stumbling block between firing current fire chief Kevin Hess and replacing him with Lizarraga.  If this information is accurate, it shows a pattern of abuse of authority which invites the attention of your agencies.  We respectfully request that such an investigation be conducted at the first opportunity.

We, the concerned citizens of Quartzsite, have stood by quietly long enough.  There are many who stand with but are reluctant to sign this letter in fear of retaliation.  Know that there are exponentially more concerned citizens who are unwilling to subject themselves to the wrath of those we ask you to investigate.

Quartzsite to hold runoff election for mayor in May







Quartzsite, Arizona - The Final un-official election results of March 13, 2012 were released by La Paz County this afternoon. 


After Tuesday's election it was reported Ed Foster was the winner, however according to Quartzsite Town Attorney, Martin Brannan, there will be a runoff for mayor in the May election. 


Foster originally held the lead with over 50% of the votes, but with the additional provisional votes, the percentage is now 49.84% to Lukkasson's 38.94%. Foster received 320 votes to Lukkasson's 250 votes. Jenny Mills received 61 votes (9.50%) and write-ins received 11 votes (1.71%). 642 votes were cast for the mayoral position. 


Candidates must win 50% of the votes plus one to win a seat outright in the primary.

Quartzsite unofficial results: Recalled Mayor Ed Foster wins over Jerry Lukkasson

Quartzsite, Arizona- Voters took to the polls today.  

626 votes were cast. The unofficial results show  

Ed Foster had 50.98% with 312 votes. 
Jerry Lukkasson had 38.40% with 235 votes.
Jenny Mills had 9.15% with 56 votes.
There were 9 Write-in votes cast.

9 candidates were seeking two Town Council positions:
Barbara Cowell had17.79% with 212 votes.
Pat Workman had 15.86% with 189 votes.
Joe Winslow had 14.43% with 165 votes.
Mark Orgeron had 13.84% with 165 votes.
It appears these top four will be in a run-off election in May.

Other candidates:
Jennifer Jones had 11.24% with 134 votes.
Starr BearCat had 8.72% with 104 votes.
Dean Taylor had 6.29% with 75 votes.
Sean Austin had 5.79% with 69 votes.
Bill Moore had 4.19% with 50 votes.
There were 22 write-in votes cast.

In the Vacancy Council Member race:
Mike Jewitt appears to reclaim his seat with 51.97% and 251 votes.
There were 232 write-in votes cast (John Prutch) with 48.03% of the votes. 

74.87% of the voters rejected a resolution to replace town ordinance asking to appoint the mayor, rather than by vote.
25.13% of the voters wanted the new town ordinance. 

The official results should be released later this week.

Town of Quartzsite's Public Defender not fired

Quartzsite, Arizona - According to a Press Release issued January 27th by Quartzsite Town Manager, Alex Taft, the town did not fire attorney Michael Frame as public defender, as previously reported online.  [Editor's note: this press release was not reported on by Desert Messenger earlier, due to time constraints and deadlines. I apologize for the lateness.] The following is the press release:

PRESS RELEASE
January 27, 2012

"The Town of Quartzsite has not “fired” Michael Frame as its public defender. Michael Frame was not a Town employee and had no long-term contract to serve as the Town’s public defender. Although the Town submitted a Request for Qualifications in the Spring of 2011, no one, including Michael Frame, submitted qualifications for consideration for a long-term contract with the Town.

Because Michael Frame’s contract with the Town had lapsed, the Town believed that it was in an implied month-to-month contract with Frame. When Frame increased his rates without giving a month’s notice to the Town, the Town realized that either its belief that it had a month-to-month agreement with Frame was erroneous or that Frame was intentionally breaching the month-to-month agreement by raising his rates without providing proper notice. In either event, the Town elected to follow the June 28, 2011 guidance from the Council and cease using Michael Frame as an exclusive public defender and to make appointments using the Superior Court’s appointment list while the town continued searching for a qualified public defender in search of a long-term agreement.

The decision by the Town Council to use the Superior Court’s rotation list was made by a unanimous vote of the Town Council, including then-mayor Ed Foster, and preceded the hiring of Martin Brannan as the Town Attorney and was not influenced by Brannan in any way. The decision to cease its perceived month-to-month contract, which was either perceived in error or breached by Michael Frame, was made solely by the Town Manager and was not influenced, in any way, by Brannan."

Quartzsite Town Attorney Martin Brannan assigns cases to special prosecutor

Quartzsite, Arizona - In a press release issued this afternoon, Quartzsite Town Attorney, Martin Brannan announced cases involving five Quartzsite residents have been assigned to a special prosecutor.

The Press Release states:

"Despite reports to the contrary, the so-called Quartzsite Bagger is not the Quartzsite Town Attorney or any other elected or appointed officer of the Town of Quartzsite. The opinions expressed on http://quartzsitebagger.wordpress.com do not represent the views of any elected or appointed officer of the Town of Quartzsite. No elected or appointed officer of the Town of Quartzsite profits in any way from the sale of merchandise by Cafe Press related to the “Quartzsite Bagger” blog.

"Notwithstanding this reality, in order for the Town Attorney and other town officers to concentrate on the business of the town without the distraction this “controversy” appears to have been designed to create, the cases involving self-styled activists Ed Foster, Jennifer Jones, Michael Roth, Dana Stadler and Doug Gilford are being assigned to a special prosecutor."

Former Quartzsite mayor Ed Foster out on bail

On October 7, 2011 former Quartzsite mayor Ed Foster turned himself in after acting Quartzsite Magistrate Karen Slaughter issued a warrant for his arrest. According to a press release issued yesterday by Quartzsite Police Chief Jeff Gilbert, Foster didn't show up to court to face charges of nonfeasance in public office. Foster was booked into the La Paz County Jail by the Parker Police Department on a $1,500.00 secured appearance bond.

Foster, who was ousted from the office of Mayor of Quartzsite following a recall election on August 30, 2011, was evidently sent a summons by the court, but it was returned unclaimed by the Post Office.
According to Quartzsite Police, Foster had personally obtained copies of the file, including the summons, from the magistrate court prior to the hearing at which he failed to appear. Foster allegedly admitted to the Court staff that he did have a copy of the summons.


Foster alleges that he complained to the State Bar of Arizona that Town Attorney Martin Brannan had acted in violation of the Arizona Rules of Professional Conduct by bringing the charge of nonfeasance in public office against him. In spite of this apparent knowledge, Foster allegedly denied that he had notice of the summons to a clerk of the Quartzsite Magistrate Court. Additional charges of violating a court order and failing to appear as required are under consideration.

According to various reports, Foster was visiting family out of state at the time of the hearing.

Jones vs. Quartzsite Mayor Lizarraga hearing set

Judge Michael Burke has set a date for a hearing on Thursday, Sept. 22nd at 10am in La Paz County Superior Court. Case No. CV201100117: Jennifer Jones vs. Jose Lizarraga. (See earlier post)

Jones is challenging the qualifications of Lizarraga as mayor. No answer was received from Lizarraga. Town of Quartzsite filed an Application to Intervene. Burke granted the town's application to intervene. The court has allotted one hour for the hearing.

Jennifer Jones challenges Quartzsite mayoral recall election

On Thursday, Sept. 8, 2011 Jennifer Jones filed a legal challenge to the mayoral recall election. Papers were filed in the La Paz County Superior Court in Parker, Ariz. In the recall election held Aug. 30, Jose Lizarraga received 302 votes,  Ed Foster garnered 245 votes, and Jennifer Jones received 23.

In a press release issued on Sept. 8th, Jones claims Lizarraga is not qualified to be mayor under Section 2-1-10 of the Town Code (Ordinance 9-15).

Jones asserts that Lizarraga violated the state of Arizona’s open meeting laws in his position as a councilperson and that he thwarted Mayor Ed Foster’s investigation into wrongdoing by the council, among other accusations. She is asking the court to find Lizarraga ineligible for office, and designate Ed Foster as the winner of the election.


According to the press release, “Lizarraga has until 5pm Wednesday, September 14th, to file a response with the court. The civil case is between private parties Jones and Lizarraga, so town attorney(s) may not represent the newly elected mayor. Jones filed "in pro per", and will represent herself.”

Remembering 9/11

The effect of September 11th, 2001 is forever etched into our memories. We all have our own story of how 9/11 changed our lives. I held the moment of silence this morning along with millions of others to honor those who lost their lives on that fateful day. Quartzsite is holding a Night of Hope Candlelight Ceremony this evening at Town Park at 7pm to allow locals the opportunity to come together in honor of this day. Emotions are raw and for many, run deep, as memories of that day flood our consciousness. This is a time to treat one another with respect and dignity. A National Day of Service.

Ten years ago today, the world was in chaos and confusion.  I was working in a small town where the owners/managers of motels became afraid for their family's safety, just because of their nationality. I realized just how prejudice we all can be. Humans tend to place blame on someone outside of themselves. It's just easier that way.

Today, emails are still being forwarded that are full of hatred for Muslims, as if ALL Muslims were responsible for the terror of that day. If I were to take this one step further, I could blame former mayor Ed Foster for ALL the comments made on his "Supporters" Facebook page. That could be the easiest thing to do, but not the healthiest. I have seen comments attacking people rather than addressing the principles of issues involved. Once again, it's just easier to attack someone we may not even know than to look inside and seek a way of understanding.



Today is a day to set aside our anger. A day for people to realize our similarities. A day to get out from behind our computer and go help someone. I hope to see those who disagree with each other come out to the park this evening and join TOGETHER with the community of Quartzsite as we move forward in our own healing process. I hope that we, as a community, will determine our future, not those who sit in judgement of who is at fault. I hope that our hearts remain open to each other, speaking words of support, encouraging one another, and sharing words of strength and hope.

We have all experienced the loss of a loved one.
Let us support the healing process for those who are suffering today
as the memories of 9/11 are shared around the world.

Jose Lizarraga new Quartzsite mayor

Lizarraga gained 12 votes while Foster gained 15 votes.

Unofficial results are in. Jose Lizarraga received 289 votes. Ed Foster received 230 votes.
Jennifer Jones received 23 votes. Mayor Ed Foster no show at hearing

Quartzsite mayor Ed Foster was a no show at La Paz County Superior Court this morning. Foster challenged the validity of the notary seal on mayor recall signatures. Foster did file a third motion at the court at 8:45 this morning requesting county supply original signature papers. However, Foster was nowhere to be found at the appointed time of the hearing. Judge Michael Burke dismissed all 3 motions.

Plus Burke awarded the town of Quartzsite their attorney fees.

Quartzsite: Two arrested at Council meeting last night

Quartzsite, AZ- Recently declared council candidate, Jennifer "Jade" Harris-Jones was arrested as she approached Quartzsite Town Hall on Tuesday evening, November 23, 2010. She was arrested on two charges: Obstructing Governmental Operations; a Class 1 misdemeanor; and False Reporting to Law Enforcement Agencies; a Class 1 misdemeanor. The charges were pertaining to an incident on Friday, November 19, 2010, when Quartzsite Building Official, Al Johnson, went to 645 N. Central Blvd., Quartzsite on official Town Business.

The property consists of J & S Covers, a year-round business owned by Jim and Stephanie Aaron, and A Fur Salon, a seasonal dog grooming vending business owned by Jennifer "Jade" Harris-Jones. During the Quartzsite Town Council meeting, Mr. Russell Sias, Manager of Crawford's RV Park and a previous candidate for council, presented manilla envelopes to each council member, Town Manager Alex Taft, and asked Town Attorny Pamela Walsma to give an envelope to Al Johnson, who was not present. Sias proceeded to the back of the room where Police Chief Jeff Gilbert stood, with crossed arms. Sias slammed the envelope into his chest and face, creating outcries from the crowd. Sargeant Javier Frausto took Sias into custody on a misdemeanor charge of assault.

Mayor Ed Foster posted bail for Harris-Jones during the night, while Sias was unable to secure bail and will appear before the judge this morning in Parker.

Quartzsite Town Council censures Mayor Ed Foster

Even before the meeting could begin, there was disruption at the Town Council meeting, Tuesday, Sept. 14, 2010. As Mayor Ed Foster began to stand for the invocation, Council member Patricia Anderson, made a motion to have one of the local pastors deliver the invocation. Arguments pursued. Town Attorney, Pamela Walsma explained there was a motion on the floor and there should be a vote. Mayor Foster said he would not recognize Council member Anderson and continued with the invocation, while the some of the council continued to sit in their chairs.
After the roll call, Mayor Foster challenged the validity of the ad hoc Ethics Committee recommendations. He said the attorney had to approve it to form. Foster said, "We are actually in illegal territory, here." He then asked Walsma if she could find anywhere in The General Powers of the Common Council ARS 9.240 and "point out where a common council can take sanctions against one of its own members". Foster then asked if anyone wanted to go into executive session. Council member Bob Kelley explained there were many meetings, but the mayor refused to attend.

ARS 9.240 STATES: #29. To adopt ordinances for the government of the corporation, its officers and persons within its corporate limits needful for the good government and order of the municipalities, and to provide the manner of prosecution and define the punishment for the violation of such ordinance.

Council member Jose Lizzarraga made a motion that Vice Mayor Barbara Cowell take over the meeting. It was seconded, but the Mayor argued the legality of it. Resident Ron Burch stepped up to the podium and asked if he could interrupt the meeting, and he did just that. He stated the discussion should be tabled.
Agenda item 1: Discussion and possible action regarding the ad hoc Ethics Committee recommmendations concerning Mayor Foster's official conduct.
Council member Anderson read a Town Codes explaining the procedures of the ad hoc Ethics Committee and "how we got here today."
Vice Mayor Cowell read a prepared statement explaining how the ad hoc Ethics Committee concluded the actions of the mayor were not minor in nature, and the procedures they had to follow.

Cowell read the letter sent to Foster dated Sept. 1, 2010 listing the 8 recommendations.

1. Require additional elected official training for Mayor Foster and Council Members.


2. Refer possible criminal matters to the Arizona Attorney General’s office or the appropriate law enforcement agency for review.

3. Direct Mayor Foster to turn over all documents, correspondence and records pertaining to or purported to pertain to Town business to the Town Clerk.

4. The Mayor may not represent the Town on any official Town business until the above referenced matters have been resolved.

5. Withhold permission for Mayor Foster to attend committee meetings or contact outside agencies in his official capacity as Mayor until the above referenced matters have been resolved.

6. Require that Mayor Foster stop using his title of Mayor in the Mineshaft blog.

7. Require Mayor Foster to comply with the Town Code, Town Council Procedure Policy, and the Personnel Policy.

8. Censure Mayor Foster for acting outside his scope of office.

Council member Lizarraga spoke saying, "I don't believe it goes far enough. I do agree any possible criminal matters be referred for prosecution. I do believe the mayor should be censured!" He read a statement asking for a written apology from the mayor to staff, Town Manager, Chief of Police, the towns people, the council. He also asked for the Mayor's immediate resignation.
Foster tried to let the public talk, but there was much yelling with the a boisterous crowd! Ron Burch started yelling. During this time, Council members Kelley, Lukkasson and Winslow got up and left the room. Vice Mayor Cowell stood up to try and calm the crowd. Quartzsite Police Chief Jeff Gilbert stepped in and demanded "we will have order!"

Council member Lizarraga continued saying, "This community is at it's very lowest. We were told by our insurance that if we did not do something, we could be held liable."
Council member Kelley said, "I've done everything I can..."
Resident Dean Taylor spoke, "How terrible it looks from where I sit. We've had more mayors than Chicago! This town is being run by a vigilante group!" As he left the podium, he said, "Go to hell!"

After some discussion about content on his website, Foster said, "I publish the truth!"
Council member Jerry Lukkasson asked, "Who do you work for? Why are you here, if not for the town?"
Foster replied he works for the people that voted him into office.
Mayor Foster addressed Chief Gilbert as "Mr. Gilbert". Chief Gilbert told the mayor that he "has a responsibility to maintain order. Quartzsite is a good place, and you are good people" turning to the crowd. Addressing the mayor, Gilbert said, "you represent all of the people! The mayor has let this meeting get out of control!" Gilbert continued saying he was one of the people that lodged a complaint against the mayor. "I applaud the council and the ad hoc committee. They have taken the right steps, for once!"
The Quartzsite Town Council voted 6 to 1 to approve the action regarding the ad hoc Ethics Committee recommmendations concerning Mayor Foster's official conduct, which includes censuring.
 
On agenda item 2 the Quartzsite Town Council voted to take action to renounce and disclaim all of the actions and communications of Mayor Foster which have occured without the prior knowledge and approval of the Town Council and to declare that all such actions and communications are not the offical acts and communications of the Town of Quartzsite.
 
Item 3 was Mayor Foster's response to the actions taken by the council. He agreed with item 1, stating that Town Manager Alex Taft has resisted training from the League of Cities and Towns.
"I agree with item 2 that the Attorney General should be called into town to investigate allegations".
Foster said he had a problem with turning over documents, as the reports included of the ad hoc committee was without redaction.
Regarding item 4, Foster said, "The ad hoc Committee does not have any authority for the council to take sanctions on one of their members."
Item 5, he said, "the same"
Item 6. "To restrict my rights, my guarantee of free speech" he would not do. "I will continue to report in the Mineshaft as mayor!"
Item 7: "If I had not complied with any laws, I will correct my actions"
 
He continued with a prepared statement saying "Chief Gilbert was guilty of harrassing me". Foster said he tried to maintain a discrete presence regarding the allegations made to agencies. Foster said, "This is a political attack orchestrated by Chief Gilbert! I will continue to do the job of the people that voted me to do."
 
Residents spoke about their concerns for the future of Quartzsite. Violet Kiss told about the Coalition meeting she attended in early June of this year, shortly after Mayor Foster took office. She said, "You directed Jade (Jennifer Harris) to sue every person on the council! You're on your own agenda and I don't believe its for Quartzsite!"
Michelle Lukkasson said she expects many people to be ready to file recall papers on Nov. 25th. Foster said Nov. 25th is his birthday and he expects a great birthday present.
 
Foster said, "Censure means nothing to me! The council cannot take sanctions against me."

Quartzsite Mayor sends letter to 3 council members

The following is a letter from Quartzsite Mayor Ed Foster delivered to three Council members' boxes on June 16, 2010. The Desert Messenger received a copy on June 17, 2010, from Quartzsite Town Hall, after filing the proper Public Record Request paperwork.

"To: Council members
Patricia Anderson, Joe Winslow, Jose Lizarraga
Subject:
Respect

If you can't respect me as Mayor you must respect the office of Mayor.

The Mayor calls meetings and if you have a problem with the schedule I propose then you can contact me by letter or phone and I will give consideration to you reasons. I am going to recognize the change you have made this time, but this will not be acceptable in the future.

No meetings of the common council of Quartzsite will be called in the future with out the consent of the Mayor.

The common council of Quartzsite was organize[d] under parliamentary rules and will be run in the future under those rules. The agenda will be set by the Mayor and nothing will be placed on the agenda unless the Mayor approves.

With so much confusing information on the Internet and some articles/websites written as fact, but are more opinion/editorial in nature, I thought it would be good for the citizens to have more clarification regarding Town Council Procedures.

Here is the exact text from the town's policy procedure manual, which is an approved ordinance :

Quartzsite Town Council Procedure Policy
(also received after filling out the proper paperwork with Town of Quartziste)

Ord. No. 09-29:

Section II. General Rules
13 - Rules of Order:
" 'Robert's Rules of Order Revised' shall govern the proceeding of the Council. The Town Attorney shall serve as the parliamentarian."

Section III. Types of Meetings
3. Work Sessions

"The Council may meet informally in work sessions at the call of the Mayor or any three (3) Members of the Council. Work sessions are open to the public, with public participation. No official action can be taken at a work session."

Section V - Order of Business & Agenda
2. Agenda-Determination of Specific Items to be included:

"Requests for items to be placed on the agenda should be submitted to the Town Manager or Town Clerk in writing no later than 11:00 am on the Wednesday of the week proceding the scheduled Council meeting. The public shall request items to be placed on the agenda through a Council Member.
"The Town Manager shall prepare a proposed agenda and meet with the Mayor, and Town Attorney to discuss and prioritize the agenda itmes and decide their placement on the agenda. A finalized copy of the agenda along with all available information pertaining thereto will be placed in the Council Members' boxes by Friday afternoon."
